Does the Max IV code make my pokemon legal or illegal?

If all IV values get to 31 but you don't generate a new PID based on the new IV values, you will have a illegal pokemon.

i got the AR code here and i am wondering if it will affect the egg i am hatching and if it will be legal after? and finally, the fossil pokemon from the museum...

Hatched or Non-Hatched, it can have all 31 IVs and be legal, but only hatched will be legal with that code.

Not quite right. There is an incredibly small but finite possibility that a non-hatched Pokemon will end up with a PID that will allow for a legal, all 31 IV spread.
However, that possibility is so minutely small it is effectively 0%.

If Nintendo game-checkers at a tourney do not detect it, then what's the problem?

They can't argue against you, it's legit. There are some already known PIDs that generate perfect IVs, just different natures.
I believe if the Nintendo guys notice that all large portion of your Pokemon's IVs are completely perfect, it's obviously skeptical. However, some guys manage to breed extremely near-perfect Pokemon and trade them at some sites, notably Smogon.
