Let's say I have a hacked pokemon. Like, a CLEARY very hacked pokemon, or more then one. If I battle my friend through nintendo wifi using this team, can nintendo detect it and ban my DSi or whatever they ban so I can't play?

To my knowledge, what they will do is not allow you to upload the vid, other than that you should be fine. I've heard of some people getting banned from the GTS and receiving "communication errors" when they try to access the gts, but im not sure its thats true.

The GTS has a legality check for Pokemon. It does not actually ban the trainer. The Battle Video share also has a legality check.

I got a "this Pokemon can not be traded" two nights ago. Picked up a Ditto a few hours ago.

Any one of several unique identifiers. There's IP address, MAC address, "Nintendo Wi-Fi Connection ID"... It's kind of a moot point though, I've never heard of anyone getting banned on a DS game.
