The issue is going online with a CFW switch, not what you import. (if the file or mon mattered, they would have banned many people who did illegal online raids and impossible trades etc) Presently they haven't done any other device ban (besides the one the CFW devs got early on). It's not known if it's by their choice, or that their detection sucks. In any case, that's all that has to be said. If you can't live with the risk, stop using CFW. Whether their detection sucks or whether it's their choice (to not ban), has nothing to do with us.
