No, you can't even access the eShop without updating.

Ive read that people who have injected into their games are getting banned from the eshop because of .bin files being detected for Shuffle. If I only used QR codes, I should be fine right? Qr codes dont add anything or move anything in the SD card? I used a seperate sd card to inject for ORAS because the one that came with my ds cant be read by my computer. I did however use the QR for shuffle.
