I had the same issue last week. All I did was wait until SpotPass downloaded a few things to the emuNAND and then it completed the update to 9.6. It was strange. Would fail everytime. Then I saw YouTube and Google presents and then all of a sudden my emuNAND fully updated.

Unfortunately my 3DS firmware was upgraded accidentally, therefore; I can no longer gen the pokes and bring them in the way I was doing it with the web exploit. Searching around online I found a SKYDS which says it can emulate any Firmware. In my head, when they released the firmware which removed the exploit in the browser, they patched it and tricking the system into thinking it is an older firmware should work, BUT I thought I would come back to a trusted source for information? The SKYDS may actually do more than emulate the firmware versions, it may actually have stored various previous version, but I don't know that. Would the SKYDS work and allow the importing of the Phex edited pokes in? Thanks.
