Technically, every lvl 1 mythical/legendary hacked to get caught on this date (Oct/28/2022) could be legal ?

Only the ones released in GO before that date.

If you're asking for them to be seen as legal in PKHeX, it's probably never going to happen. It was an unwanted glitch quickly removed by Niantic, hence not an intended mechanic.
